No jail or prison ever sentence a murdered for life without parole not necessarily of that hard labor. Parole of hard labor is not considered to be paroled( a conditional release of a prisoner serving an indeterminate or unexpired sentence) in the first place. More importantly it depends on what a Supreme Court Justice defines cruel and unusual is.
